Thanks .... he definetly did not like the crate ... we live in a street house and he would just cry and howl for ages so it wasn't fair on the neighbours and their ears . He's much better just on his bed downstairs .. but now he has found out how to get upstairs and its a new area for him so he has started crying again on a night when we leave him. It's like we've gone back over ...
Toilet wise he's really good sometimes a little accident on a morning but all day he goes outside.

At 10 weeks old, it's honestly better to let them sleep close to you than leave them to cry. A pup can only learn to be independant if he feels secure and that he can trust you, and being abandoned - as it seems to him - at night is very scary for him. Could he sleep on a bed (or in the crate if he's not become fearful of it) next to your bed? Then you can easily reassure him if he cries, and you will also be able to respond if he needs to toilet.
