Advice Needed

I could do with a bit of advice if any ones been in a similar situation.

A solicitor was supposed to be exacter of a will as one person didn't get one with the other 2. no contact was made to the 3rd person (we will call the rd person tom) for a few months since a letter was received saying the house was going on the marker to sell and be split 3 ways.

After hearing nothing for weeks. Tom saw the solicitor and was told the house was now in all 3 persons names Toms dicks and Harry's and they were no longer executors that they had handed it over to tom dick and harry. All so Dick had moved into the house had taken it off the market and was doing it up before selling it at a later dates as this is what dick and harry wanted. Non of this Tom new about till he spoke to the solicitor ad everything all ready been done. nobody contacted Tom but Dick told the solicitor he had been in contact with tom and everything was agreed

All tom wants is his share of the house as it was valued less expenses and the dick and harry can do what ever they want with the house Tom wants this last tie broken with them so he can cut all contact can he make them ether sell the house or give him a 3rd of the price that was agreed when the house was going on the market. Is there away Tom can just get what his mum wanted him to have and get away from them. Surly Dick and Harry cant do just what they wanted go against the Will Tom just wants it over with. Does anyone have any advice or ideas. Tom has signed nothing and doest know how they can get away with go against a will. Hes left with his and there names on the deeds of a house he just wants rid off.

If their is a will stating that tom is entitled to anything then he gets it, need a copy of the will via solicitors also if he is on the deeds then he is entitled to his share, if they want to be funny with tom he can put a stop on the house so i can't be sold until it is sorted, i cant think of what that is called but he can doit, but he obviously needs to go the the solicitor to get it in place, but as long as their is toms name anywhere in writing then he is entitled to a share, good luck families turn very ugly when someone dies,

Thanks for the advice tonys had a look through but carnt fined anything thats fits the case. hes tryig to get legal advice for tom. Toms problem is he is now on deeds of a houes with dick and harry and that dick is living in and dick and harry dont want to sell. yet Tom wants it sold and over with. when there mum died dick didnt live there and hes moved in after her death. all tom wants is the houes sold and no more contact ever with dick and harry.

sorry no advice for you,

but i would think tom is right, it should have been a split decition on what happened to the house, and if dick and harry didnt want to sell they should buy tom out, for the share of the current market price.

well thats what we think espcily as all this was done behind toms back. the last tom heard from the solisitor the houes was being sold. then as he hadnt heard anything for a few months he went in and was told all this had happend he had no idea of it didnt agree to it and has signed anything. dick had said to the solisitor that Tom new about it and agreed but tom has no cotact and doesnt want any with eather dick or harry. so Toms in a bit of a state now

Hi, I'm quite certain that they should have to buy his share out of they intent to keep the house on, have you contacted the citizens Advice, they will tell you his rights!

toms been to the solisitor gain apparantly dick moved in then told the solisitour he hd done it and allso said tom gave his persision for dick to move in. the solisitour has sent dick stronly worded letter as he has been lyed to and he has to give dick 3 week to reply then after that action will be taken to eather get dick and or harry to by tom out our for them to sell the houes. it does seam the solisitor is doing a bit of back peddling as no contact or info was forwarded to tom about all this by him. hes trying to get an appontment with CAB as we think gettig as much advice as posibel and playing compltly by the book is the best bet. after all dick and harry are showing there true colours like they allways do evencaly. troubl is tom allways has loads of hassle till people realied what dick and tom get up to. one day Tom will et away from them for good witch is all he wants
